These Terms of Service (“Terms”) govern your use of The Night Observer website at thenightobserver.com (the “Site”), including related pages, feeds, and content we publish. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Our Privacy Policy explains how we handle information and is incorporated by reference into these Terms.

What The Night Observer Is

The Night Observer is an automated paranormal news aggregator and media project. We collect publicly available news headlines and summaries, generate original commentary and creative media (including images and short-form video), and may share that material on the Site and on third-party platforms such as Instagram, Bluesky, Threads, TikTok, and similar services.

The Site does not require user accounts or registration. You may browse content freely.

Acceptable Use

You agree not to:

• Use the Site in any way that violates applicable law or regulation.
• Attempt to disrupt, scrape abusively, overload, or compromise the Site or its hosting infrastructure.
• Misrepresent affiliation with The Night Observer or use our branding to deceive others.
• Use automated means to access the Site in a manner that harms availability for other visitors (reasonable indexing by search engines and personal reading tools is fine).

Third-Party Content and Links

Story headlines and source links point to external publishers. We do not control and are not responsible for third-party websites, their accuracy, availability, or policies. Visiting those sites is at your own risk and subject to their terms.

Aggregated headlines and descriptions are presented for informational and entertainment purposes. We do not claim ownership of third-party news articles. Original commentary, field notes, site design, and media we create remain ours as described below.

Intellectual Property

Unless otherwise noted, the Site’s design, logos, original writing, illustrations, generated imagery, and video we produce are owned by The Night Observer or used under license. You may share links to our pages and our social posts for personal, non-commercial purposes. You may not copy, republish, or commercially exploit our original content without prior written permission, except as allowed by fair use or other applicable law.

Social Media and Platform Integrations

We may operate official accounts and applications that post to third-party platforms (for example, TikTok, Instagram, Bluesky, or Threads) using those platforms’ APIs and developer tools. Use of those platforms is governed by their own terms and policies. Connecting or interacting with our accounts on those services does not create a separate account with us on the Site.

Disclaimer of Warranties

The Site and all content are provided “as is” and “as available,” for entertainment and informational purposes. Paranormal topics are inherently speculative. We do not warrant that content is complete, accurate, timely, or suitable for any particular purpose, or that the Site will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, The Night Observer and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Site or reliance on any content. Our total liability for any claim relating to the Site will not exceed USD $100.

Indemnity

You agree to indemnify and hold harmless The Night Observer and its operators from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

Changes

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of the Site after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles, except where prohibited by local law that applies to you.
